Terms and Conditions of Sale: www.8grams.store
1) Purpose
These general terms and conditions of sale aim to define the rights and obligations of the parties arising from the sale of coffees, coffee machines, and other accessories offered by the company 8 GRAMS SRL ("Seller"), owner of 8grams.store (VAT number BE 0799 891 989, Maastrichtersteenweg 10 in 3770 Riemst) and the user ("Buyer").
This contract is the only one that establishes the relationship between the seller and the buyer. In the event of a condition that is not in compliance or a breach, it will be governed by Belgian law applicable in the coffee machine sales sector.
These general conditions and our specific conditions apply to all our sales in Belgium and abroad.
The seller reserves the right to change these terms at any time and without notice. In particular, our prices, duration, and delivery times may be subject to revision at any time. However, such changes cannot affect orders placed before the modified terms are posted on the website.
Any order or use of the services provided by the seller implies the automatic acceptance of the conditions and the waiver by the contracting party of its own general conditions. Technical information or other data of good faith to the contracting party are based on the seller's current experience. However, multiple factors may be beyond the seller's control. Giuseppe Greco therefore disclaims any liability for this information.
2) Product, price, and orders
Each product comes with a description provided by the supplier.
Catalog photographs are as faithful as possible but cannot ensure a perfect similarity with the offered product, especially regarding colors.
These products and services are offered subject to availability. If, despite its efforts, all or part of the items are unavailable, the seller will inform the buyer by email as soon as possible and offer the option to choose between waiting or canceling the order for the unavailable items without charge. The available items will be delivered as usual.
Prices: prices are indicated in Euros, and valid in all Eurozone countries. They include any discounts as well as VAT, applicable on the day of the order. The prices applicable to the order are those in force at the time of confirmation.
Shipping costs will be in EUR amounts but will vary depending on the destination and weight of the packages.
We retain full ownership of the goods until full payment of the price, accessories, and any other expenses related to the purchase. In case of non-payment of the full price and all accessories, we reserve the right to terminate the contract and/or suspend any current order.
Online orders
The customer has the option to place an order online from the references on the website.
The order can only be recorded on the site if the customer has clearly identified themselves by registering as indicated on the website.
Any order constitutes acceptance of these general terms and conditions of sale as well as the prices and description of the products sold.
The seller undertakes to honor orders received on the website only within the limits of the available stock of products.
If the item is out of stock, the seller may deliver to the customer an item similar in characteristics or superior at an equivalent price.
Within 24 hours after placing the order, the seller will send the customer a confirmation email to the email address provided.
3) Recording of personal data
Any natural or legal person who places an order during a visit to the website www.8grams.store as a potential contracting party communicates their personal data when ordering.
Placing an order via the website implies explicit consent that this identification data may be processed in the seller's data file.
Only natural or legal persons with full legal capacity and authority may place an order via the website.
The data controller of the customer's personal data is the seller.
The processing of this personal data in the seller's data file is for the purpose of customer administration, order management, delivery, billing for tangible and intangible services, monitoring solvency, advertising via profiling, personalized processing, and marketing.
Giuseppe Greco reserves the right to collect data about the customer, particularly when placing an order or by using cookies.
All personal data are intended for the seller's internal use only.
In accordance with the Law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, you have the right of access and rectification of this data at any time, as well as the right to object if you no longer wish to be informed of our activities.

4) Delivery
The customer has the choice of delivery:
• Either at home or at a third-party address,
• Or at the headquarters located at Maastrichtersteenweg 10 in 3770 Riemst
The products are delivered to the customer at the delivery address provided by the same customer when placing the order online or offline, and in the following countries/regions: Belgium, France, Germany, Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Denmark, Spain, Estonia, Finland, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Lithuania, Luxembourg, Malta, Norway, Netherlands, Poland, Portugal, Czech Republic, United Kingdom, Serbia, Slovakia, Slovenia, Sweden, and Switzerland. In the event that the delivery address differs from the billing address, the customer must provide both separate addresses on the order form.
It is also the customer's responsibility to provide all useful information for delivery when placing the order to enable the carriers to proceed with the delivery. In case of incorrect or incomplete information resulting in the carrier's inability to deliver, a second delivery will be made after the return by the carrier of the goods to the seller, subject to prior payment of new shipping costs by the customer.
The choice of the destination country must be made at the time of ordering.
Any change of destination, resulting in the issuance of specific document(s), will be charged a flat rate of 50€.
The seller undertakes to make deliveries of the ordered items as quickly as possible.
The average delivery time for available items is 7 working days.
For picking up packages at the operating location (Maastrichtersteenweg), a valid ID is required. Failing this, the ordered products cannot be delivered.
Any delivery problem (missing or damaged item) must be reported to us within 48 hours at +32(0)495/18.47.29
The corresponding returned item must then be sent to us within 14 working days after receipt, requesting exchange or refund.
5) Payment
Accepted payment methods: Credit Cards (We work with Stripe), Bank Transfer, or PayPal.
6) Late payment
In case of late payment, the amounts due accrue interest at the rate of 1% per month from their due date. In this case, the contracting party will also be liable for a fixed and non-reducible indemnity equal to 15% of the amount due. In the event of non-payment of an invoice on its due date, the total price of the sale, including accessories, becomes immediately due in full by the contracting party. Furthermore, the seller reserves the right to terminate the contract automatically without further formality and without prejudice to our rights to any damages and interests.
7) Damages due to improper use
Any merchandise damaged as a result of mishandling after delivery will not be returned or exchanged.
8) Guarantees
The products are guaranteed by their manufacturers for the duration and according to the terms indicated in the product description on the price offer or on the online store www.8grams.store and/or on the warranty certificate possibly included with the products upon delivery.
For orders placed via the online store (www.8grams.store): In case of a defective product, the user/buyer has 14 working days to return the product; otherwise, the notion of "malfunction upon first use" cannot be retained. No return will be possible beyond the warranty period offered by the manufacturer for the products concerned. The costs and risks associated with the return of the defective product are borne by the consumer.
The seller cannot commit to any processing time for the return of defective products since after-sales service operations are carried out by the manufacturer of the products concerned. The warranty for defective products is subject to the full payment of their price by the consumer. Malfunctions caused by improper use of the product or by external causes (such as electrical surges, for example) cannot be guaranteed.
List of warranty exclusions:
- breakage;
- normal wear and tear parts such as gaskets, filters, cartridges, hoses, grilles ...;
- malfunctions related to accessories;
- defects due to corrosion or oxidation;
- damage caused by external causes (flood, lightning, storm...);
- malfunctions, damage, defects due to insufficient maintenance or intervention by a person not authorized by the seller or the brand;
- defects and their consequences due to improper use (it is essential to read the user manual, especially the instructions for commissioning);
- makeshift or temporary repairs;
- premature wear due to use beyond the manufacturer's recommendation or for professional purposes;
- incorrect assessment of technical characteristics and product description;
- use of a product other than originally intended by the manufacturer.
9) Disputes and controversies
Belgian law exclusively governs this agreement. In the event of a dispute, only the courts of the judicial district of Liège are competent.
