General conditions of sale: www.8grams.store

1) Purpose
The purpose of these general terms and conditions of sale is to define the rights and obligations of the parties arising from the sale of coffees, coffee machines and other accessories offered by the company 8 GRAMS SRL ("Seller"), owner of 8grams.store (VAT number BE 0799 891 989, Maastrichtersteenweg 10 in 3770 Riemst) and the user ("Buyer").

This contract is the only one that connects the seller and the buyer. In the event of a condition that is not compliant or a breach, this would be that of the Belgian law in force in the sector of the sale of coffee machines.

These general conditions and our specific conditions apply to all our sales in Belgium and abroad.

The Seller reserves the right to change these terms at any time and without notice. In particular, our prices, duration and delivery times may be subject to revision at any time. However, said change will not affect orders placed before the posting of the modified terms on the Website.

Any order or use of the services made available by the seller implies automatic acceptance of the conditions and the waiver by the other contracting party of its own general conditions. The technical information or other data given in good faith to the other contracting party is based on the current experience of the seller. However, multiple factors may be beyond the seller's control. Giuseppe Greco therefore declines all responsibility concerning this information.

2) Product, price and orders
Each product is accompanied by a description established by the supplier.

The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.
These products and services are offered while stocks last. If, despite its efforts, all or part of the items are unavailable, the seller will inform the buyer by email as soon as possible and offer the buyer the option of waiting or cancelling the order for the unavailable items free of charge. Available items will be delivered as normal.
Prices: prices are indicated in Euros, and are valid in all countries in the Euro zone. They take into account any discounts and VAT, applicable on the day of the order. The prices applicable to the order are those in effect at the time of confirmation of the order.
Shipping costs will be in EUR amounts but will vary depending on the destination and weight of the packages.
We retain full ownership of the goods until full payment of the price, accessories and any other costs related to the purchase. In the event of non-payment in full of the price and all accessories, we reserve the right to terminate the contract and/or suspend any current order.

Online orders
The customer has the possibility to place his order online from the references on the site.
The order can only be registered on the site if the customer has clearly identified himself by registering as indicated on the website.
Any order constitutes acceptance of these General Conditions of Sale as well as the prices and description of the products sold.
The seller undertakes to honor orders received on the website only within the limits of available stocks of products.
If the item is out of stock, the seller may deliver to the customer a similar item with equivalent or superior characteristics and at an equivalent price.
Within 24 hours of placing the order, the seller will send the customer a confirmation email to the email address provided.

3) Recording of personal data
Any natural or legal person who places an order when visiting the website www.8grams.store as a potential contracting party, communicates their personal data when ordering.
Placing an order through the site implies explicit consent that these identification data may be processed in the seller's data file.
Only legal entities or individuals with full legal capacity and the right to act may place an order via the site.
The controller of the customer's personal data is the seller.
The processing of these personal data in the seller's data file takes place for the purposes of customer administration, order management, deliveries, invoicing of tangible and intangible services, solvency monitoring, advertising by means of the profile, personalized processing and marketing.
Giuseppe Greco reserves the right to collect data on the customer, in particular when the customer places an order or through the use of cookies.
All personal data is intended for the internal use of the seller.
In accordance with the Law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, you have the right to access and rectify this data at any time, as well as the right to object if you no longer wish to be informed of our activities.

4) Delivery
The customer has the choice of having it delivered:
• Either at home or at the address of a third party,
• Either at the head office located at Maastrichtersteenweg 10 in 3770 Riemst

The products are delivered to the customer at the delivery address provided by the same customer when ordering online or offline, and in the following countries/regions: Belgium, France, Germany, Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Denmark, Spain, Estonia, Finland, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Lithuania, Luxembourg, Malta, Norway, Netherlands, Poland, Portugal, Czech Republic, United Kingdom, Serbia, Slovakia, Slovenia, Sweden and Switzerland. In the event that the delivery address is different from the billing address, the customer must provide these two separate addresses in the order form.

It is also the customer's responsibility to provide all useful information for delivery when ordering in order to allow the carriers to proceed with the delivery. In the event of incorrect or incomplete information resulting in the carrier being unable to proceed with the delivery, a second delivery will be made after the carrier returns the goods to the seller, subject to prior payment of the amount of new shipping costs by the customer.

The choice of destination country must be made at the time of ordering.

Any change of destination, resulting in the publication of specific document(s), will be billed at a flat rate of €50.

The seller undertakes to deliver the items ordered as quickly as possible.

The average lead time observed for available items is 7 working days.

For collection of parcels at the place of operation (Maastrichtersteenweg), a valid identity document is required. Otherwise, the ordered products cannot be delivered.

Any delivery problem (missing or damaged item) must be reported to us within 48 hours at +32(0)495/18.47.29
The corresponding returned item must then reach us within 14 working days after receipt requesting exchange or refund.

5) Payment
Accepted payment methods: Bank cards (We work with Stripe), Bank transfer or PayPal.

6) Late payment
In the event of late payment, the amounts due shall bear interest at the rate of 1% per month from their due date. In this case, the other party shall also be liable for a fixed and irreducible indemnity equal to 15% of the amount due. In the event of non-payment of an invoice on its due date, the total price of the sale, including accessories, shall be immediately due by operation of law by the other party. In addition, the seller reserves the right to terminate the contract automatically without further formalities and without prejudice to our rights to any damages.

7) Damage due to improper use
Any merchandise damaged due to mishandling after delivery will not be returned or exchanged.

8) Guarantees
The products are guaranteed by their manufacturers for the duration and according to the terms indicated on the description of the products appearing on the price offer or on the online store www.8grams.store and/or on the warranty certificate possibly attached to the products upon delivery.

For orders placed via the online store (www.8grams.store): In the event of a defective product, the user/buyer has 14 working days to return the product, otherwise the notion of "failure on first use" cannot be retained. No return will be possible beyond the warranty period offered by the manufacturer on the products concerned. The costs and risks associated with the return of the defective product are the responsibility of the consumer.

The seller cannot commit to any processing time for the return of defective products since after-sales service operations are carried out by the manufacturer of the products concerned. The warranty for defective products is subject to full payment of their price by the consumer. Malfunctions caused by improper use of the product or by an external cause (such as an electrical surge, in particular) cannot give rise to a warranty.
List of warranty exclusions:

- breakage;
- normal wear parts such as seals, filters, cartridges, hoses, grids, etc.;
- breakdowns relating to accessories;
- failures due to corrosion or oxidation;
- damage caused by external causes (flood, lightning, storm, etc.);
- breakdowns, damage, failures, defects due to insufficient maintenance or the intervention of a person other than a technician approved by the seller or by the brand;
- defects and their consequences linked to improper use (it is essential to read the user manual and in particular the instructions for commissioning);
- makeshift or temporary repairs;
- premature wear due to use exceeding the manufacturer's recommendation or for professional purposes;
- poor assessment of the technical characteristics and description of the product;
- the use of a product other than that initially intended by the manufacturer.

9) Disputes and disputes
Belgian law is exclusively applicable to this agreement. In the event of a dispute, the courts of the judicial district of Liège shall have sole jurisdiction.
